2026 BASF Customer Confidence Survey Sweepstakes Official Rules

1.            Eligibility: The BASF Customer Confidence Survey Sweepstakes (the “Sweepstakes”) is open only to participants who (1) are legal residents of one of the United States and maintain a BASF account in District 107, 201, 301, 303 or 404 (each a “District”), (2) are at least 18 years of age or the age of majority in the jurisdiction where they reside, whichever is greater, at the time of entry, (3) receive the 2026 BASF Customer Confidence Survey (“Survey”) directly from BASF, and (4) complete and submit the Survey.  Only one Survey per person will be accepted.

Not eligible to win:

a)      Employees, contractors, directors, officers and agents (collectively “Employees”) of:

i.        BASF Agricultural Solutions US LLC (“Sponsor”) and

ii.      Sponsor’s parent, affiliates, subsidiaries, sales representatives, and

iii.     Sponsor’s advertising, promotion and judging agencies and all other service agencies involved with the Sweepstakes, and

Members of the immediate family and household members of each such Employee (whether or not related), where “Members of the immediate family” is defined as an Employee’s spouse, parent, child, sibling, and their respective spouses, regardless of where they reside.   

This Sweepstakes is subject to all applicable federal, state, and local laws and regulations and is void outside the United States and where prohibited.  Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes.  Winning a prize is contingent upon fulfilling all requirements set forth herein.  

2.           Sponsor: The Sponsor of the Sweepstakes is BASF Agricultural Solutions US LLC, 2 TW Alexander Dr, Research Triangle Park, NC 27713.  The Sweepstakes are in no way sponsored, endorsed, or administered by, or associated with RTIC Outdoors, LLC, and RTIC Outdoors, LLC has not authorized or otherwise approved the Sweepstakes.  By entering the Sweepstakes, entrants fully release and hold RTIC Outdoors, LLC, harmless from liability.

3.            Sweepstakes Entry Period:  BASF will accept Surveys submitted from June 30, 2026, at 8:00 am EDT through July 31, 2026, at 11:59 pm EDT (“Entry Period”).

4.            How to Enter:  During the Entry Period above, entrant must complete and submit the Survey.  Each Survey submitted is automatically entered in the Sweepstakes.

5.            Entries.   Sponsor and its agents, affiliates, subsidiaries, representatives and service providers may use entrant’s personal information submitted with entry for purposes of prize fulfillment.  The Sponsor will not sell personal information.

Sponsor is not responsible for lost, late, illegible, misdirected, or incomplete entries or invitations, incorrect or inadvertent deletion or filing of an entry, or other errors or malfunctions of any kind whether human, mechanical, electronic or otherwise.  Proof of submission of entry will not be deemed proof of receipt by the Sponsor.  No facsimiles or mechanical reproductions of entries allowed. Submissions become property of Sponsor and will not be returned.  Automated entries are prohibited, and any use of automated devices will cause disqualification. Entrants may not enter with multiple identities.  Any entrant who attempts to enter under multiple identities, will be disqualified and forfeits any and all prizes won, in Sponsor’s sole discretion.  

6.            Entrant Verification: Sponsor will review and verify each entry as it is submitted.  At the closing of the Entry Period, Sponsor will segregate all eligible entries by District (each a “District Pool”).   Any entrant who is found not to be eligible for this Sweepstakes will be disregarded and will not be eligible for the drawing.  Individuals who do not follow all of the instructions and/or abide by these Official Rules or other instructions of Sponsor may be disqualified.  Ineligible individuals will not receive notification or any correspondence from Sponsor of their ineligible status.  

7.            Prize Drawing: One Drawing will be conducted for each District Pool (Districts 107, 201, 301, 303, and 404), and one (1) potential winner will be randomly selected from each District Pool.  

The drawing will take place on August 1, 2026, at approximately 9:00 a.m. EDT.  The odds of winning depend on the number of eligible entries received in each District Pool. 

Each selected entrant will be deemed a potential winner, subject to verification.  Sponsor will attempt to notify potential winners by email on or about August 3, 2026.  If a potential winner cannot be contacted, is determined to be ineligible, or fails to claim the prize and provide any required documentation (including a mailing address, and if applicable, an affidavit and release) within five (5) business days of notification, the prize may be forfeited and an alternate winner may be selected from the same District Pool.

The Sponsor reserves at its sole discretion the right to not award a prize or to determine an alternate winner, also subject to verification, in accordance with the Official Rules in the event that a winner has been disqualified, cannot be contacted, or is deemed ineligible for any reason.

As a condition of participating in the Sweepstakes, each entrant agrees and acknowledges that in order to be deemed a winner, each potential winner may be required to sign and return a Publicity Release and agree to all terms herein or prize may be forfeited.  A potential prize winner’s failure to return all required forms within this time period may result in the potential winner being disqualified and an alternate winner may be determined by Sponsor, in its sole discretion and in accordance with the Official Rules.  

If a potential winner is disqualified for any reason, the Sponsor reserves the right to determine an alternate winner by conducting a random drawing from among all remaining eligible entrants.  By participating in this Sweepstakes, each entrant agrees (a) to be bound by these Official Rules; and (b) as between entrant and the Sponsor, the decisions of the Sponsor are final on all matters relating to the Sweepstakes; and (c) in the event that entrant does not comply with these rules, he/she will be disqualified, and the prize (if any) will be forfeited.  

8.            Prize; Taxes: Each verified winner will receive one (1) RTIC® 6-gallon Halftime Water Cooler (approximate retail value: $150.00 US).  The prizes offered herein shall be the only prizes awarded in this Sweepstakes.  All prize details not specified herein are at Sponsor’s sole discretion.

Prizes are non-transferable, non-assignable, and no cash, cash equivalent, or substitution of prize is offered, except at the sole discretion of the Sponsor.  If a prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right to substitute prize with another prize of equal or greater value.  Federal, state and local taxes and any fees and expenses related to acceptance and use of a prize not specifically stated herein, if any, remain the sole responsibility of each winner.  Sponsor is not responsible for and will not replace any prizes that are lost, damaged or stolen after prizes have been given to the winners. THE SWEEPSTAKES AND PRIZES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.

9.                Release: As a condition of entering this Sweepstakes, each entrant agrees (and agrees to confirm in writing): (a) to release Sponsor and its affiliates, subsidiaries, retailers and agents, and each of their officers, directors, employees and agents, from any and all causes of action arising out of or connected with this Sweepstakes or any prize awarded, and further releases and holds Sponsor harmless from liability, illness, injury, death, loss, litigation, claim, judgment,  or damage incurred with respect to the awarding, receipt, possession and/or use or misuse of any prize, whether caused by negligence or not; and (b) under no circumstances will any entrant be permitted to obtain a prize for another entrant; and (c) hereby knowingly and expressly waives all rights to claim punitive, incidental, consequential or any other damages; and (d) all causes of action shall be resolved individually, without resort to any form of class action; and (e) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred (if any), excluding attorneys’ fees and court costs. 

10.                Publicity and Personal Information: Except where prohibited by law, each winner grants (and agrees to confirm this grant in writing, if requested) permission for Sponsor and those acting under its authority to use winner’s name, portrait, picture, photograph, voice, likeness, image, and/or statements about this Sweepstakes, and any and all identifying characteristics and biographical information including, but not limited to, the taking of photograph(s) and/or video(s) by Sponsor or its designee, for educational, promotional, publicity, or advertising and promotion purposes, without limitation, and without any further compensation, notice, review, or consent.  Each winner grants to Sponsor a royalty-free, worldwide, perpetual, irrevocable, and assignable right to use such photograph(s) and/or video(s), including derivative works of the same, in any and all media (including, but not limited to, websites, social media, press releases, and printed publications and materials) now known or hereinafter invented or created without territorial or time limitations and without compensation.  

Personal information collected from entrants is subject to the Sponsor’s Private Policy available at:  Data Privacy (basf.com) (https: www.basf.com/us/en/legal/data-protection.html) which includes a specific Notice for California Residents (CCPA Notice).

11.                General Conditions: Sponsor is not responsible for lost, late, misdirected, undelivered, incorrect or inaccurate entry information however caused, including but not limited to security controls, Internet users, or by any of the equipment or programming associated with or utilized in this Sweepstakes or by any technical or human error which may occur in the processing of the entries.  Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes or the Official Rules, or any part of it/them, if any fraud, bug, virus, technical failures, or any other factor beyond Sponsor’s reasonable control corrupt, impair, or affect the administration, security, fairness, proper conduct, or the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion.  In the event of cancellation, Sponsor will randomly award the prize from among all eligible, non-suspect entries received prior to cancellation.  Sponsor is not responsible for computer system, phone line, hardware, software or program malfunctions, or other errors, failures or delays in computer transmissions, the website, or network connections that are human or technical in nature.  Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process, the website, or the operation of the Sweepstakes or to be acting in violation of the Official Rules of this or any other promotion or acting in an unsportsmanlike or disruptive manner.  Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes, including but not limited to multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by these Official Rules; or the use of bots, macros, scripts, or other technical means for entering.  Any attempt by any person to deliberately damage any website or undermine the legitimate operation of this Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.  Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision.  

12.                Binding Arbitration: Entrant agrees that any controversy or claim arising out of or relating to this Sweepstakes shall be settled by binding arbitration in a location determined by the arbitrator as set forth herein (provided that such location is reasonably convenient for claimant), or at such other location as may be mutually agreed upon by the parties, in accordance with the procedural rules for commercial disputes set forth in the Comprehensive Arbitration Rules and Procedures of JAMS (“JAMS Rules and Procedures”) then prevailing, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.  The arbitrator shall be selected pursuant to the JAMS Rules and Procedures.  The arbitrator shall apply North Carolina law for all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and the Sponsor in connection with the Sweepstakes, consistent with the Federal Arbitration Act and applicable statutes of limitation and shall honor claims of privilege recognized at law.  In the event that entrant is able to demonstrate that the costs of arbitration will be prohibitive as compared to the costs of litigation, Sponsor will pay as much of the filing and hearing fees in connection with the arbitration as the arbitrator deems necessary to prevent the arbitration from being cost-prohibitive.  If any part of this arbitration provision is deemed to be invalid, unenforceable or illegal (other than that claims will not be arbitrated on a class or representative basis), or otherwise conflicts with the rules and procedures established by JAMS, then the balance of this arbitration provision shall remain in effect and shall be construed in accordance with its terms as if the invalid, unenforceable, illegal, or conflicting provision were not contained herein.  If, however, the portion that is deemed invalid, unenforceable, or illegal is that claims will not be arbitrated on a class or representative basis, then the entirety of this arbitration provision shall be null and void, and neither entrant nor Sponsor shall be entitled to arbitrate the dispute.  Upon filing a demand for arbitration, all parties to such arbitration shall have the right of discovery, which discovery shall be completed with sixty (60) days after the demand for arbitration is made, unless further extended by mutual agreement of the parties.  THE ARBITRATION OF DISPUTES PURSUANT TO THIS PROVISION SHALL BE IN THE ENTRANT’S INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.  THE ARBITRATOR MAY NOT CONSOLIDATE OR JOIN THE CLAIMS OF OTHER PERSONS OR PARTIES WHO MAY BE SIMILARLY SITUATED.  ENTRANT SHOULD NOT ENTER THIS SWEEPSTAKES IF HE/SHE DOES NOT AGREE TO HAVE ANY CLAIM OR CONTROVERSY ARBITRATED IN ACCORDANCE WITH THESE OFFICIAL RULES.  BY PARTICIPATING IN THE SWEEPSTAKES, ENTRANT AGREES, TO THE EXTENT PERMITTED BY LAW: (1) ANY AND ALL DISPUTES, CLAIMS, AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE SWEEPSTAKES, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY THROUGH BINDING ARBITRATION AS SET FORTH ABOVE, WITHOUT RESORT TO ANY FORM OF CLASS ACTION, AND (2) ENTRANT’S REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND (3) ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF.  SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSIONS OF LIABILITY SET FORTH ABOVE AND IN SECTION 9, SO SUCH LANGUAGE MAY NOT APPLY TO EVERY ENTRANT.

13.                Governing Law & Jurisdiction: This Sweepstakes and its Official Rules are governed by U.S. law and are subject to all applicable federal, state and local laws and regulations.  All issues and questions concerning the construction, validity, interpretation and enforceability of the Sweepstakes Official Rules, or the rights and obligations of entrants and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of North Carolina, U.S.A., without giving effect to the conflict of laws rules thereof, and any matters or proceedings which are not subject to arbitration as set forth in Section 12 of these Official Rules and/or for entering any judgment on an arbitration award, shall take place in the State of North Carolina in the City of Durham.
