1.  Participant Eligibility: The BASF Liberty ULTRA Herbicide Sweepstakes (the “Sweepstakes”) is open only to participants who are (1) legal residents of one of the United States, (2) at least 18 years of age or the age of majority in the jurisdiction where they reside, whichever is greater, at the time of entry, and (3) are active agricultural producers.    This Sweepstakes is not open to the general public.

Employees, contractors, directors, officers and agents of BASF (“Sponsor”) and each of Sponsor’s parent, affiliates, subsidiaries, distributors, sales representatives, and advertising, promotion and judging agencies and all other service agencies involved with the Sweepstakes, and members of their immediate family (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) and any household members (whether or not related) are not eligible to enter or win.  

This Sweepstakes is subject to all applicable federal, state, and local laws and regulations and is void outside the United States and where prohibited. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein.  

2.  Sponsor: The Sponsor of the Sweepstakes is BASF Agricultural Solutions US LLC, 2 TW Alexander Dr, Research Triangle Park, NC 27713.  Owners of brand or trade names awarded as prizes are not sponsors of the Sweepstakes, and the Sweepstakes have not been authorized or otherwise approved by them.

3.  Entry Periods: The Sweepstakes entry periods are as follows, and each is an “Entry Period.”

• February.  The period for submitting an entry for February is from Noon EST on February 1, 2026, until 11:59 PM EST on February 28, 2026;
• March.  The period for submitting an entry for March is from Noon EST on March 1, 2026, until 11:59 PM EST on March 31, 2026; 
• April.  The period for submitting an entry for April is from Noon EST on April 1, 2026, until 11:59 PM EST on April 30, 2026.

4.   How to Enter: There are two ways to enter during each Entry Period.  Entrant must either:

(a)   Complete an entry form at [libertyultramonials.com] and submit a text, photograph, or video regarding entrant’s use of Liberty ULTRA herbicide on entrant’s field (each such submission known as an “ULTRAMonial”).  Each ULTRAMonial must meet the following criteria to be eligible (with compliance determined by BASF in its sole discretion):

(a)    Entry must:

                                                     i.     reflect favorable performance of entrant’s experience with Liberty ULTRA herbicide, and

                                                   ii.     not be offensive or derogatory about BASF, its brands, or its people, and

                                                  iii.     not refer to any other manufacturer names or brands.

(b)    Photograph Entries:

                                                     i.     must be clear, and

                                                   ii.     show visible performance of Liberty ULTRA herbicide.

(c)     Video Entries:

                                                     i.     Must share what entrant appreciates about Liberty ULTRA herbicide, and

                                                   ii.     must be at least ten (10) seconds but no more than two (2) minutes long, and

                                                  iii.     must have clear audio.

(d)    Photographs and Video Entries:

                                                     i.     must not include any minors, and

                                                   ii.     must have written releases from any adult shown, and

                                                  iii.     must not contain sexually explicit, nude, obscene, violent, or other objectionable or inappropriate content.

By submitting an ULTRAMonial, entrant represents and acknowledges that he/she is the sole creator and copyright owner of each such entry submitted and grants to BASF, in perpetuity, a worldwide, exclusive license to publish, reproduce, modify, edit, and otherwise use and exploit each ULTRAMonial submitted for any and all purposes BASF desires, including but not limited to publication, distribution, advertising, and marketing purposes (“Marketing”), for internal and external purposes, all without extra compensation to or additional consent of entrant.  Entrant waives the right to inspect or approve an ULTRAMonial (or portion thereof) used by BASF or the copy used in connection therewith or the use in which it is applied. Entrant releases, discharges, and agrees to hold harmless BASF and those acting under its permission or upon its authority, from and against any and all damages, liability, costs, and expenses arising from the use of submission, including, without limitation, any claim based on publicity rights, defamation, invasion of privacy, copyright infringement, trademark infringement or any other intellectual property or other cause of action whatsoever.  ULTRAMonials that violate or infringe a third party’s rights, including but not limited to copyright, are not eligible.  Winning a prize does not guarantee that that submission will be used by BASF in any Marketing.  For the avoidance of doubt, ALL ULTRAMonials submitted, including those not winning a prize, may be used by BASF in Marketing as provided in this paragraph, in BASF’s discretion.

OR

(b)    Mail to Sponsor, with postage fully pre-paid, to BASF ULTRAMonial Sweepstakes, Attn. Amy McEvoy, 2 TW Alexander, Research Triangle Park, NC 27713-2847, entrant’s first and last name, name of entrant’s farm, mailing address, email address, telephone number, and date of birth (hereafter referred to as an “Alternate Method of Entry” or “AMOE”).  Entry must contain all requested information to be eligible. Date for determining which Entry Period the entry may be eligible for is the DATE RECEIVED BY BASF.  Entry must be received within an Entry Period to be eligible for that drawing.

Entrants may submit no more than one (1) ULTRAMonial entry OR one (1) AMOE each Entry Period.  Entries submitted by the AMOE have an equal opportunity to win the same prizes offered to other entries.  Eligible entries will remain in the drawing after each drawing.  The odds of winning depend on the number of eligible entries received.   

Sponsor and its agents, affiliates, subsidiaries, representatives and service providers may use the personal information submitted with Event registration for purposes of prize fulfillment. The Sponsor will not sell personal information.

Sponsor is not responsible for lost, late, illegible, misdirected, or incomplete entries, incorrect or inadvertent deletion or filing of an entry, or other errors or malfunctions of any kind whether human, mechanical, electronic or otherwise. Proof of submission of entry will not be deemed proof of receipt by the Sponsor. No facsimiles or mechanical reproductions of entries allowed. Submissions become property of Sponsor and will not be returned. Automated entries are prohibited, and any use of automated devices will cause disqualification. Entrants may not enter with multiple identities. Any entrant who attempts to enter under multiple identities will be disqualified and forfeits any and all prizes won, in Sponsor’s sole discretion.  

5.  Entrant Verification: As each entry is submitted, Sponsor will review and verify all entries. Any entrant found not to be eligible for this Sweepstakes, or whose submission does not qualify, will be disregarded. Ineligible individuals or submissions will not receive notification or any correspondence from Sponsor of their ineligible status.

6.  Drawing: At the close of each Entry Period, Sponsor will put all eligible entries into a drawing to award one Prize each month.  Prizes are non-transferable.  Individuals who do not follow all of the instructions and/or abide by these Official Rules or other instructions of Sponsor may be disqualified.

For each Entry Period, there will be one winner, randomly selected from among all eligible entrants.  Drawings will be held at 5:00 PM EST on the fourth of the month following the close of each Entry Period (unless such date falls on a federal holiday, a Saturday, or a Sunday, and then the drawing will be held on the first business day thereafter).  For example, the drawing for the February Entry Period will be at 5:00 PM EST on March 4, 2026.

Each winner will be selected as follows: the Sponsor will conduct a drawing to determine the prize winners by randomly selecting from the eligible entries. The prize winner will be contacted by phone and/or email within forty-eight (48) hours of the drawing. The winning entrants may or may not respond at the time of the selection to claim their prize. If a winner cannot be contacted, is ineligible, or fails to claim the prize and confirm his/her mailing address within five (5) business days from the time award notification is given or was sent, the prize may be forfeited.  At Sponsor’s option, Sponsor will either mail or hand-deliver the Prize to the winner.  If mailed, Sponsor will cover shipping charges.  There is no limit to the number of times an entrant can win.

The Sponsor reserves at its sole discretion the right to not award a prize or to determine an alternate winner in accordance with the Official Rules in the event that a winner has been disqualified, cannot be contacted, or is deemed ineligible for any reason.  

As a condition of participating in the Sweepstakes, entrants agree and acknowledge that in order to be deemed the winner, the potential winner may be required to sign and return a Publicity Release and agree to all terms herein or prize may be forfeited. The potential prize winner’s failure to return all required forms within this time period may result in the potential winner being disqualified and an alternate winner may be determined by Sponsor, in its sole discretion and in accordance with the Official Rules.  

If a potential winner is disqualified for any reason, the Sponsor reserves the right to determine an alternate winner by conducting a random drawing from among all eligible entrants. By participating in this Sweepstakes, entrant agrees (a) to be bound by these Official Rules; and (b) as between entrant and the Sponsor, the decisions of the Sponsor are final on all matters relating to the Sweepstakes; and (c) in the event that entrant does not comply with these rules, he/she will be disqualified, and the prize (if any) will be forfeited.  

7.  Prize: The winner selected at the monthly drawing will receive the following applicable prize:

• February Entry Period.  ActionHeat^TM 5V Battery Heated Work Jacket, Retail $230.
• March Entry Period.  Milwaukee® Packout^TM Storage System – 3 piece Kit, Retail $375.
• April Entry Period.  YETI® Tundra Haul® Wheeled Cooler, Retail $450.

Sponsor does not make, nor in any manner is it responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to the prize including but not limited to its quality, authenticity, fitness for purpose or condition. All costs not specifically stated herein as being awarded are the responsibility of the winner. All prize details not specified herein are at Sponsor’s sole discretion. The difference in value of prize as stated herein and value at time of prize notification, if any, will not be awarded.  

No cash equivalent or substitution of prize is offered, except at the sole discretion of the Sponsor. If a prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right to substitute prize with another prize of equal or greater value. Odds of winning depend upon the number of eligible entries received. Federal, state and local taxes and any fees and expenses related to acceptance and use of a prize not specifically stated herein, if any, remain the sole responsibility of the winner. Sponsor will not replace any prizes that are lost, damaged or stolen after prizes have been given to the winners. THE SWEEPSTAKES AND PRIZES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.  

8.  Release: As a condition of entering, entrants agree (and agree to confirm in writing): (a) to release Sponsor and its affiliates, subsidiaries, retailers and agents, and each of their officers, directors, employees and agents (“Promotion Parties”), from any and all liability, loss or damage incurred with respect to the awarding, receipt, possession and/or use or misuse of any prize; and (b) under no circumstances will any entrant be permitted to obtain a prize for another entrant; and (c) hereby knowingly and expressly waives all rights to claim punitive, incidental, consequential or any other damages; and (d) all causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action; and (e) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred (if any), excluding attorneys’ fees and court costs. The prizes offered herein shall be the only prizes awarded in this Sweepstake.  

9.  Publicity and Personal Information: Except where prohibited by law, each winner grants (and agrees to confirm this grant in writing, if requested) permission for Sponsor and those acting under its authority to use his/her name, photograph and/or likeness, for advertising and/or publicity purposes in any and all media now known or hereinafter invented without territorial or time limitations and without compensation. Information collected from entrants is subject to the Sponsor’s Private Policy available at:  Data Privacy (basf.com) (https: www.basf.com/us/en/legal/data-protection.html) which includes a specific Notice for California Residents (CCPA Notice).

10.  General Conditions: Sponsor is not responsible for lost, late, misdirected, undelivered, incorrect or inaccurate entry information however caused, including but not limited to any technical or human error which may occur in the processing of the entries. Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, bugs, virus, technical failures, or any other factor beyond Sponsor’s reasonable control impair the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. In the event of cancellation, Sponsor will randomly award the prize from among all eligible, non-suspect entries received prior to cancellation. Sponsor is not responsible for computer system, phone line, hardware, software or program malfunctions, or other errors, failures or delays in computer transmissions, the website, or network connections that are human or technical in nature. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process, the website, or the operation of the Sweepstakes or to be acting in violation of the Official Rules of this or any other promotion or acting in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision.  

11.  Disputes: Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, other than those concerning the administration of the Sweepstakes or the determination of winners, shall be resolved individually, without resort to any form of class action; (ii) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, shall be resolved exclusively by the appropriate U.S. District Court for North Carolina for Durham County, or the appropriate North Carolina state court sitting in Durham County; (iii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (iv) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO ALL ENTRANTS. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of North Carolina, without giving effect to any choice of law or conflict of law rules (whether of the State of North Carolina and or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of North Carolina.  

12.  Governing Law & Jurisdiction: This Sweepstakes and its Official Rules are governed by U.S. law and are subject to all applicable federal, state and local laws and regulations. All issues and questions concerning the construction, validity, interpretation and enforceability of the Official Rules, or the rights and obligations of entrants and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of North Carolina, without giving effect to the conflict of laws rules thereof, and any matters or proceedings which are not subject to arbitration as set forth in Section 11 of these Official Rules and/or for entering any judgment on an arbitration award, shall take place in the State of North Carolina in the City of Durham.
